The promotion of online gambling on digital platforms has evolved into a complex and difficult to control unlawful activity, primarily because it exploits weaknesses in state oversight. This study therefore aims to analyze the state’s responsibility and the mechanisms for supervising the promotion of online gambling. The research employs a normative legal method using statutory and conceptual approaches. The findings show that the state bears the responsibility to regulate, supervise, and enforce the law against the promotion of online gambling as mandated by UUD NRI Tahun 1945, which requires the state to protect its citizens from various threats, including illegal digital content. To achieve this, the state needs to expand the scope of legal subjects who may be held accountable, provide clearer standards regarding prohibited conduct for each legal subject, establish explicit legal obligations for digital platforms to carry out proactive content moderation, and ensure continuous and sustainable oversight.
